The decision of the Magistrates court was to quash the abatement notice, as the court felt that, having taken into account the character, content, views and effect on the average person, the nuisance did not amount to statutory nuisance.

The court awarded costs against Mid Beds District Council of £7406.50

The court made a decision based on the evidence submitted today. Clearly the complainants are disappointed and Mid Beds were carrying out their statutory duty in responding to these complaints.

We will now consider our position as to whether or not we will appeal.
