Construction Site Noise
A certain amount of noise is inherent in most types of Construction, Demolition and Road works, which can rarely be completely prevented. However, noise can be very disturbing to local residents and adjacent businesses and therefore site managers should operate their sites with consideration to local people.
The main laws covering Construction Sites are The Control of Pollution Act 1974 which covers noise and vibration control and The Environmental Protection Act 1990 (EPA 1990) which covers smoke and dust emissions. Under The Control of Pollution Act 1974 a Local Authority can serve a Notice imposing requirements as to the way in which works are to be carried out. Generally the notice may impose restrictions and conditions on working hours, methods of work, permitted noise levels and type of equipment used.
Hours of work
Contractors are usually expected to adhere to the following hours of working for any work being carried out in Mid Beds which causes noise at the site boundary:
Monday to Friday
0800 to 1800 Hrs
Saturday
0800 to 1300 Hrs
Sundays and Bank Holidays
No working
In some circumstances permission may be given by Environmental Services for operations to be undertaken outside of these hours. However, it would have to be demonstrated that the works could not be carried out at any other time and that methods of work and operation of plant and equipment were designed to keep noise to a minimum. For example sometimes work on major roads is undertaken outside peak traffic times in order to minimise traffic congestion and ensure the safety of construction workers.
Sometimes emergency works will have to be undertaken, for example a burst water main or major power failure. The permitted hours of work restrictions would not apply in these circumstances. The works are likely to be undertaken as quickly as possible at the time the emergency occurs.

Advice for Contractors
Contractors planning to undertake Construction, Demolition or Road Works are advised to contact Customer Services on 01462 611222 or 08452-304040 to discuss their proposals as early as possible before starting the works. An application can be made for Prior Consent over times of working, noise levels and methods of work. Early discussions and agreement can avoid the service of a notice once work has commenced which can seriously restrict the planned work programme for the site.

It is important to communicate with nearby residents who may be affected by the works. Pre-warning regarding specific disturbing operations will usually avoid later confrontation and complaints.
A code of practice BS5228 has been issued by the British Standards Institute, which suggests ways of reducing noise at construction sites.
